SMS Delivery Policy

This policy (“Policy”) applies to all transactional and operational SMS communications (“SMSs”) generated and delivered through the d-flo SMS Delivery Service (“Service”).

By generating and sending SMSs through the Service, you agree to comply with this Policy. d-flo may suspend or terminate your access to and use of the Service if you do not comply with this Policy.

Your use of the Service must comply with all applicable Laws.

This includes laws applicable to you and also laws applicable to d-flo and the recipient for SMSs. Examples of applicable laws include laws relating to spam, phishing, cyber-attack, Unsolicited Commercial Communications (UCC), privacy, security, obscenity, defamation, bullying and harassment, discrimination, intellectual property infringement, pornography, terrorism, homeland security, gambling, child protection, and other applicable laws including the UK’s Data Protection Act 1988 and the replacement Data Protection Act 2018 (DPA) and EU’s General Data Protection Regulation (GDPR) and other regional directives and regulations relating to data protection, privacy, consumer protection from unfair trading and/or email marketing. It is your responsibility to know and understand the laws applicable to your use of the Service and the SMSs you generate and send through the Service.

Use of the Service must comply with your d-flo Framework or Maintenance & Support Agreement.

This Policy is a part of and incorporated into the Agreement applicable to the Service. It is your responsibility to read and understand the Agreement applicable to your use of the Service and the SMSs you generate and send through the Service.

Use of the Services must comply with your d-flo Data Processing Agreement.

This Policy is a part of and incorporated into the Agreement applicable to the Service. It is your responsibility to read and understand the Agreement applicable to your use of the Service and the SMSs you generate and send through the Service.

Use of the Service must follow all applicable guidelines established by d-flo.

The guidelines below are examples of practices that may violate this Policy when generating and sending SMSs through the Service:

  • Sending non-transactional or non-operational SMSs.
  • Sending SMSs to anyone that you do not have a contractual obligation to send SMSs.
  • Using third-party mobile phone numbers without proper permission.
  • Sending SMSs that result in an unacceptable number of spam or UCC complaints (even if the SMSs themselves are not actually spam or UCC).
  • Including “junk mail,” “chain letters,” “pyramid schemes,” incentives (e.g., coupons, discounts, awards, or other incentives) or other material in SMSs that encourages a recipient to forward SMSs to another recipient
  • Unlawfully using and/or processing personal data in contravention of the above Laws including but without limitation UK’s Data Protection Act 1988 and the replacement Data Protection Act 2018 (DPA) , EU’s General Data Protection Regulation (GDPR) and any other regional data protection, privacy, consumer protection from unfair trading and/or email marketing or allowing third parties to do so on your behalf and without the consent of the data owner or subject.
